Pretrial hearing for Brandon Daniel postponed

A pretrial hearing for Brandon Daniel, 26, scheduled for Thursday afternoon was postponed until Dec. 18.

Daniel has been charged with capital murder in the shooting death of Austin police officer Jaime Padron last year.

Padron responded to a call at a North Austin WalMart in the early morning hours of April 6, 2012. Store employees reported a drunken man—later identified as Daniel—causing a disturbance inside of the store.

Police said that when Padron arrived, the officer approached Daniel and Daniel took off running. Padron chased him down and tackled him near the store's entrance.

During the struggle, witnesses say Daniel fired two shots from a semiautomatic pistol, striking Padron once in the neck, killing him, according to Daniel's arrest affidavit.

Daniel was arrested at the scene and, according to his arrest affidavit, admitted spontaneously to officers that he had "killed a cop."

Following her son's arrest, Daniel's mother spoke to media from her Colorado home. She described her son as intelligent with a bright future ahead of him, but a recent breakup had sent Daniel into a bout of depression. She said he had been abusing alcohol and prescription medicine in the months leading up to the shooting.
